What am I entitled to if I am hurt on the job?
New Jersey law requires that employers (or their insurance carrier) provide and pay for necessary and reasonable medical treatment for employees who are injured at work. In addition, they must pay lost wages (which are generally calculated at a rate of 70% of the worker’s average weekly pay) while the worker is unable to work and under continuous medical care due to their work-related injury/illness. Finally, they must pay appropriate benefits for permanent partial or total disability.
Why do I need a lawyer?
Unfortunately, many employers and insurance companies refuse treatment, refuse to admit the injury occurred in the workplace, attempt to pressure workers not to proceed in an action or to accept much less financial compensation than they deserve or even illegally terminate workers following their injury. We understand many people shy away from discussions about death or estate planning because it is sad, stressful and overwhelming. The truth is, though, that estate planning is absolutely essential.
We recommend that every adult have estate planning documents prepared by an experienced attorney. If you have recently had a major life change, such as a divorce, marriage or birth/adoption of a child, we recommend that you consider having new documents made to align with your current situation.

What happens if you die without a will in New Jersey?
The short answer is… things are much more complicated. An administrator must be appointed by the Surrogate’s Court to handle your estate. This may or not be the person you would have chosen for this important role. Real estate and property will then be divided between a surviving spouse and biological or legally adopted surviving children. A genealogist may need to be hired to determine which, if any, other family members may be entitled to proceeds, especially if there is no surviving spouse or children. If there are no known relatives all property will go to the State of New Jersey.
Everyone should have a Last Will and Testament, particularly any adult who has children and/or owns any property. Your will appoints an Executor you trust who will be responsible for ensuring that your wishes are carried out. It also outlines who will have legal custody of your minor children and have the responsibility for their care if something should happen to you. This is especially important in complicated situations such as those where there are no blood-related family members or where you feel your children’s best interests would be served by living with a specific individual who might not otherwise be considered. Your will also lists your beneficiaries, the people you choose to inherit your property, personal belongings and money. If any of those beneficiaries could be under 18 then your will also appoints someone you choose to handle their funds in a Trust and how you want them to do so.
What is an advanced directive and why do I need one?
Everyone should have appropriate advanced directives. An advanced directive is an important document that enables you to plan for the medical treatment you want to receive in the future. There are two key types of advanced directives.
Living Will: A living will is a legal document that clearly states your wishes for the medical treatment and care you wish to receive in the event that you become incapacitated. In other words, if you are sick or injured and cannot speak for yourself, this document tells the medical professional how you want them to proceed. It can provide very specific requests and information regarding end-of-life care and medical interventions.
Medical Power of Attorney: A medical power of attorney is another essential legal document. It designates a specific person who can make medical decisions on your behalf if you are unable to do so. This is extremely important because it ensures that someone you trust can make key decisions about your care, ensures that your wishes are respected and avoids conflicts and stress among family members.
